When do I need an Badger Survey?

Badgers are legally protected under the Protection of Badgers Act 1992 and is in place to prevent activities such as badger baiting. This law makes it a serious offence to kill, injure, interfere or take a badger. Any proposed development site needs to be assessed for any active badger setts, with the appropriate remedial action taken place. This species is often found during the initial Phase 1 Habitat Survey or Preliminary Ecological Appraisal. However, should the species be found, further action may be necessary.

Prior to any development, protected species are required to be considered prior to the approval of planning. The following species are protected and must be considered:

- Bats
- Badgers
- Birds
- Otters
- Reptiles
